THE TWO THRESHOLDS
Where the lines actually fall
STANDARD TIER · 200 TO 799
Premises used wholly or mainly for a Schedule 1 use where 200 or more people may reasonably be expected to be present at the same time (s.2(2)(c)). The duties are procedures for evacuation, invacuation, lockdown and communication, and notification to the regulator.
ENHANCED TIER · 800 AND ABOVE
The same, at 800 or more (s.2(3)(c)). It adds public protection measures, a compliance document, and a designated senior individual where the responsible person is not an individual.
A qualifying event is a separate test again (s.3(1)): premises the public can access to attend, 800 or more people expected, and entry conditional on payment, a ticket, a pass or membership, checked at the door. Six conditions, all of which have to be met. An event in a public park still qualifies even though the park itself is excluded from the premises definition, which is the case most often got wrong.
COUNTING PEOPLE
The number is peak simultaneous, and it includes staff
Not the total through the door across a day. It is the most people present at any one moment, and everyone working counts. There are six recognised ways of arriving at it, from the non-statutory Supplementary Document A. Two of them, historic attendance data and ticket allocation, count the public only, so staff have to be added separately.
- Method A: fire safety occupancy figure
- Method B: historic attendance data (counts the public only, add staff separately)
- Method C: fixed capacity, such as seating
- Method D: tickets and pre-registration (counts the public only, add staff separately)
- Method E: licence or other capacity restriction
- Method F: another method you can justify
The duties are not yet in force. Commencement is expected no earlier than spring 2027 and the date is not confirmed. For what each tier has to do, read the tier guide, or Martyn's Law translated for live events.
